With Joe Biden embroiled in a scandal for mishandling classified documents, there has been continued talk about his possible impeachment.
However, a terrifying scenario has emerged that could make Kamala Harris the president for 10 insufferable years.
Mike Davis, former Senate Judiciary Committee staffer and current head of a conservative legal organization, first brought forward the frightening scenario.
“Per the 22nd Amendment, if President Biden leaves office after January 20, 2023, a President Harris could still run for two 4-year terms (10 years total). If Biden left office before then, Harris could only run for one 4-year term (6 years total),” Davis tweeted, adding a link to a Congress.gov site explaining the 22nd Amendment.

Section 1
No person shall be elected to the office of the President more than twice, and no person who has held the office of President, or acted as President, for more than two years of a term to which some other person was elected President shall be elected to the office of the President more than once. But this Article shall not apply to any person holding the office of President when this Article was proposed by the Congress, and shall not prevent any person who may be holding the office of President, or acting as President, during the term within which this Article becomes operative from holding the office of President or acting as President during the remainder of such term.
January 20th marks the halfway point of Biden’s first term.
But who seriously thinks Biden will make it to 2025?
Here’s just a shortlist of items that may derail any hopes Biden has at seeing a second term:
- His advanced age and mental capacity
- Biden family corruption and the “laptop hell”
- Classified documents
It’s quite possible Biden won’t finish his first term.
So, could that potentially give us 10 years of Kamala Harris?
The 22nd Amendment, ratified in 1951, was passed in the aftermath of President Franklin Roosevelt’s presidency.
Roosevelt was elected to four terms.
His presidency started in 1932 and he died in office in 1945.
The amendment placed a two-term limit on the presidency and stated that serving more than two years of someone else’s term counts as a full term.
However, serving less than two years of someone else’s term doesn’t prevent an individual from seeking the presidency two additional terms.
If Biden stepped down after January 20th, Harris would be eligible for two additional full terms.
Yikes!
The Western Journal cited historical examples:
For example, when John F. Kennedy was assassinated in the third year of his presidency in 1963, Vice President Lyndon Johnson stepped in and finished the last year-plus of that term and successfully ran for election himself the following year.
He was eligible to run again in 1968, but he had become very unpopular by that point due to the Vietnam War and did not seek a second full term.
By contrast, when President Richard Nixon resigned in August 1974 over a year after being re-elected in 1972, Vice President Gerald Ford became president and served the last two-plus years of Nixon’s term.
Ford ran for election and narrowly lost to Democrat Jimmy Carter in 1976, but had he won, he would not have been eligible to run again in 1980 because he had already served over two years of Nixon’s term.
The chances of Biden leaving or being forced from office before Jan. 20 seem pretty remote, so conceivably Harris could become president sometime this year and then be eligible to run for two more terms.
